Are You Liable if a Trick-or-Treater Injures Themselves on Your Porch or Walkway in NY, NJ, or CT?

By Timothy Cellino

Halloween brings more visitors to residential properties than almost any other night of the year. Children and their guardians may be walking up unfamiliar driveways, climbing porch steps, and crossing yards after dark, sometimes while wearing costumes that make it harder to see where they are going.

If a trick-or-treater falls because of a broken step, uneven walkway, poor lighting, loose decoration, or another dangerous condition, the property owner could potentially be responsible for the resulting injuries. But simply getting hurt on someone else’s property does not automatically make the homeowner liable.

Premises liability laws differ between New York, New Jersey, and Connecticut. If you or your child was injured on someone else’s property, Cellino Law can help. Contact us for a free case evaluation online or call us at 888-888-8888 to speak with a member of our team.

Key Takeaways About Halloween Premises Liability

  • Homeowners and property owners have legal duties to people who enter the property, but those duties differ between New York, New Jersey, and Connecticut.
  • A homeowner is not automatically liable simply because someone falls or is injured on their property.
  • An injured trick-or-treater’s own actions are considered by insurance when determining responsibility and compensation for injuries.
  • Liability can become more complicated when a municipality or third party is responsible for maintaining the area where the injury occurred.

Can a Homeowner Be Liable When a Trick-or-Treater Falls?

A homeowner can potentially be liable when a dangerous condition on the property causes someone to be injured. In order for the homeowner to be found liable, it must be proven that they failed to take reasonable steps to correct a known condition or adequately warn visitors about it.

Premises liability law is based on negligence, so an injured person typically needs to show that beyond an injury occurring, the owner contributed to that by acting negligently. The condition of the property, the hazard itself, and what the homeowner knew or reasonably should have known can all factor into whether or not they are truly at fault.

For example, liability may become an issue if someone falls because of:

  • A broken porch step or loose handrail
  • A large crack or uneven section of walkway
  • Wet leaves or another slippery condition
  • An unsecured extension cord stretched across the walkway
  • Decorations blocking or narrowing a set of stairs
  • Poor lighting around steps or changes in elevation
  • A hole or other unexpected condition in the yard

In New York, New Jersey and Connecticut, property owners and those who control property have a duty to maintain it in a reasonably safe condition. A premises liability claim involving a dangerous condition requires evidence that the owner created the condition or had reasonable knowledge that it existed.

Does Inviting Trick-or-Treaters Onto Your Property Matter?

Turning on the porch light, putting out Halloween decorations, or otherwise welcoming trick-or-treaters can make it reasonably foreseeable that children and families will approach the home and use the porch, stairs, driveway, or front walkway.

That does not make a homeowner responsible for every accident. It can, however, be relevant when determining whether reasonable precautions should have been taken based on how the property was being used.

For example, a homeowner expecting dozens of children to walk up a set of porch stairs at night may need to consider whether the stairs are adequately lit and free of hazards. A decoration that an adult resident can easily step around during the day could create a different risk when children are approaching in costumes after dark.

How Does Premises Liability Differ Between NY, NJ, and CT?

Premises liability rules can differ significantly between New York, New Jersey and Connecticut, particularly when it comes to comparative fault and how the law evaluates a visitor’s status. Those differences can matter in a Halloween injury case because whether a trick-or-treater was invited, expected or otherwise permitted to be on the property may affect the duty a homeowner owes.

New York (Pure Comparative Fault)

New York generally requires property owners to maintain their property in a reasonably safe condition under the circumstances. Rather than relying primarily on rigid categories of visitors, New York focuses on factors such as reasonable care, control of the property, the nature of the dangerous condition and whether the risk was foreseeable.

When a trick-or-treater is injured because of an alleged dangerous condition, important questions may include whether:

  • A dangerous or defective condition actually existed
  • The homeowner or another responsible party created the condition
  • The homeowner knew about the condition
  • The condition was visible and existed long enough that it reasonably should have been discovered
  • The condition caused the person’s injuries

For example, a noticeably loose porch step that had remained unrepaired for several weeks may raise different liability questions than a temporary hazard that developed moments before an accident.

New York also follows pure comparative fault for ordinary premises liability claims. If an injured person is found partially responsible for an accident, they can generally still recover compensation, but the amount awarded is reduced according to their percentage of fault. The newer limitation that can bar recovery when a plaintiff is more at fault than the parties they are suing applies to certain motor vehicle injury cases under Article 51, not ordinary injuries involving a porch, walkway or other property condition.

New Jersey and Connecticut (Modified Comparative Fault)

New Jersey and Connecticut both use modified comparative fault, meaning an injured person’s own share of responsibility can affect whether they are able to recover compensation at all. In both states, an injured person generally cannot recover if their negligence is greater than the combined negligence of the parties from whom they are seeking compensation.

The two states can differ, however, in how they evaluate the relationship between the property owner and the person who was injured.

New Jersey: Premises liability law considers factors including why the person was on the property and their legal status as a visitor. New Jersey has traditionally distinguished among business invitees, social guests or licensees, and trespassers, with different duties potentially applying to each category.

A trick-or-treater’s status depends on the circumstances. Homeowners should not assume that a Halloween visitor has no legal protection simply because the child or family was not personally invited. A porch light, Halloween decorations or other indications that the homeowner was participating in trick-or-treating could help show that visitors were reasonably anticipated.

The homeowner’s knowledge of a dangerous condition can also be important. If the homeowner knew about a condition that created an unreasonable risk to visitors, failing to correct the hazard or provide an adequate warning could potentially support a premises liability claim, depending on the circumstances.

Connecticut: Connecticut also considers a visitor’s legal status when determining the duty a property owner owes. Connecticut law provides that social invitees are owed the same standard of care as business invitees, and property owners generally owe invitees reasonable care to keep their premises reasonably safe for anticipated uses.

Whether a particular trick-or-treater qualifies as an invitee depends on the circumstances surrounding the visit. Evidence that a homeowner was actively welcoming Halloween visitors, such as through decorations or other indications that trick-or-treaters were expected, could therefore be relevant when determining the duty owed.

Notice can also play an important role. An injured person may need to establish that the property owner actually knew about the specific unsafe condition or that the condition existed long enough, and under circumstances that made it reasonably discoverable.

In both New Jersey and Connecticut, an injured person’s own negligence can reduce the compensation available. If their share of fault is greater than the combined fault of the parties they are seeking compensation from, however, modified comparative fault can prevent them from recovering damages altogether.

What If a Halloween Decoration Causes the Injury?

Halloween decorations can create hazards when they interfere with the normal path people use to reach the front door. Extension cords, inflatable decorations, stakes, artificial fog equipment, pumpkins, wires, and other items can become tripping hazards when they are placed near a porch or walkway.

Lighting can also create a safety issue. Decorative lights may look good while still leaving stairs or changes in elevation difficult to see. If a homeowner changes an area that visitors are expected to walk through, evidence about how the decoration was installed and whether a safer alternative was available could become relevant after an accident.

A homeowner who personally placed an object in a walkway may also face different liability questions from a homeowner who claims they did not know about a particular hazard. When a property owner creates a dangerous condition, there may be less need to establish that they had prior notice of it.

Could Someone Else Be Responsible Besides the Homeowner?

The person who owns the home is not necessarily the only party who could be responsible. Premises liability often depends on who owned, occupied, controlled, or was responsible for maintaining the area where the injury occurred.

Depending on the property, responsibility could involve a landlord, tenant, condominium or homeowners’ association, property management company, maintenance contractor, or municipality. An accident on a privately owned front walkway, for example, can raise different questions from an accident caused by a defect on a public sidewalk.

Determining who controlled the area can therefore be an important part of investigating a premises liability claim. Lease agreements, maintenance contracts, photographs, surveillance footage, and inspection or repair records may help establish who was responsible for the condition.

What Should You Do if You or Your Child Is Injured While Trick-or-Treating?

After a fall or another injury, documenting the condition can be especially important because Halloween decorations may be removed and temporary hazards can disappear quickly. If possible, take photographs or videos showing the area where the accident occurred, including the walkway, steps, lighting, decorations, and anything else that may have contributed to the fall.

You should also consider getting the property owner’s contact information, identifying anyone who witnessed the accident, and seeking medical attention for injuries. Keep medical records, photographs, clothing or footwear involved in the accident, and other documentation that could help establish what happened.

Avoid assuming that the homeowner is automatically responsible or that the accident was automatically your fault. Premises liability cases can turn on details that may not be obvious immediately after an injury.

Injured on Someone Else’s Property in NY, NJ, or CT? Call Cellino Law

Halloween should be an enjoyable night for families, but a dangerous porch, walkway, staircase, or yard can quickly lead to a serious injury. Whether a homeowner or another party is responsible depends on the condition that caused the accident, who controlled the property, what they knew or reasonably should have known, and the premises liability laws of the state where the injury occurred.

The attorneys at Cellino Law can investigate what happened, identify the parties responsible for maintaining the property, preserve evidence, and explain how New York, New Jersey, or Connecticut law may affect your claim.
