New York’s E-bike and E-scooter Laws

Under New York State law, e-bikes and e-scooters are not considered traditional motor vehicles, so they don’t require registration or insurance. However, their classifications affect where you can ride and what protections apply if you’re injured.

E-bikes are divided into three classes based on speed and how the motor assists the rider:

  • Class 1: Provides electric assist only while pedaling and stops providing power at 20 miles per hour.
  • Class 2: Can be powered by the motor alone, also up to 20 miles per hour.
  • Class 3: Generally allowed only in large cities like New York City, can be motor-powered up to 25 miles per hour, and requires riders to wear helmets.

E-scooters, on the other hand, are limited to speeds of 15 miles per hour and can be used on roads with speed limits of 30 mph or less or in bike lanes. Riding on sidewalks is generally prohibited.

These classifications matter because they determine how insurance laws apply if you’re injured. For example, if a motor vehicle hits you while you’re on an e-bike or e-scooter, you may be covered by no-fault insurance. But if no vehicle is involved, your own health insurance will likely cover any injuries you may have sustained.
