What Drivers Should Know About School Bus Laws in NY, NJ, and CT

Yellow buses are a familiar sight during the morning and afternoon commute throughout the school year, but the rules for driving around them can vary depending on the state. New York, New Jersey, and Connecticut all require drivers to stop in certain situations when a school bus is loading or unloading students. The required stopping distance and rules for divided highways are different in each state.

These laws are meant to protect children as they get on or off the bus, cross the street, or wait at a bus stop. Loading and unloading can be particularly dangerous because children may enter the roadway from places where other drivers cannot easily see them.

What Do Flashing School Bus Lights Mean?

School buses use warning lights to let nearby drivers know when they are preparing to pick up or drop off students. Flashing yellow or amber lights mean the bus is getting ready to stop. Drivers should slow down and be prepared to stop instead of trying to get around the bus before the red lights come on.

Flashing red lights mean the bus has stopped to pick up or drop off students. At that point, drivers must stop when required under the law of the state where they are traveling and remain stopped until they are allowed to proceed.

Drivers should not assume the road is clear just because they cannot immediately see a child. A student could be crossing in front of the bus, approaching from the side of the road, or standing somewhere the bus blocks them from view.

New York School Bus Laws for Drivers

In New York, motorists approaching a school bus displaying flashing red lights must stop at least 20 feet away. The requirement applies to drivers approaching from either direction, even when the school bus is on the opposite side of a divided highway.

Once stopped, drivers must remain in place until the bus starts moving again or the bus driver or a traffic officer signals that they may proceed. Drivers should still watch for children near the roadway as they pass the bus.

Passing a stopped school bus can also lead to fines and other penalties in New York. Drivers should begin slowing down as soon as they see the bus’s yellow warning lights flash.

New Jersey School Bus Laws for Drivers

In New Jersey, drivers must stop at least 25 feet from a school bus displaying flashing red lights when traveling on a two-lane road or another roadway where opposing traffic is not separated by a physical barrier. Drivers approaching from either direction must stop.

The rule is different on certain divided highways. A motorist approaching from the opposite side of a roadway separated by a safety island or raised median may pass the stopped bus at no more than 10 mph. Drivers traveling on the same side as the school bus must still stop at least 25 feet away.

New Jersey also allows motorists to pass at no more than 10 mph when a school bus is stopped directly in front of a school, day camp, or certain school-related activities, provided the requirements of the law are met.

Connecticut School Bus Laws for Drivers

Connecticut requires drivers approaching a school bus with flashing red lights to stop at least 10 feet from the front or rear of the bus. Motorists must remain stopped until the bus stops displaying its red lights or they are otherwise permitted to proceed by a traffic officer.

On an undivided road, drivers must stop whether they are following the school bus or approaching it from the opposite direction. However, drivers approaching from the opposite direction do not have to stop when a safety island or other physical barrier separates the roadway.

A first violation of Connecticut’s school bus stopping law carries a $450 fine. Beginning October 1, 2026, a third or subsequent conviction will also result in a mandatory six-month license suspension.

How Do Divided Highway Rules Differ?

One of the biggest differences between school bus laws in New York, New Jersey, and Connecticut is what drivers must do when a bus is stopped on the opposite side of a divided roadway.

In New York, drivers must stop even when the bus is on the opposite side of a divided highway. In New Jersey, a driver separated from the bus by a safety island or raised median may continue past at no more than 10 mph. In Connecticut, drivers traveling in the opposite direction do not have to stop when a safety island or other physical barrier separates them from the bus.

This can be especially important for drivers who regularly travel between these states. The fact that you can legally continue past a bus in New Jersey or Connecticut does not mean you can do the same thing after crossing into New York.

Why Passing a Stopped School Bus Is So Dangerous

Getting on and off a school bus can put children close to moving traffic or require them to cross the roadway. School bus-related injuries can happen while a child is approaching the bus, crossing the street, stepping off, or waiting at a bus stop.

Drivers can also cause accidents by speeding through a school zone, failing to yield, driving while distracted, or illegally passing a stopped school bus. A school bus can block a driver’s view of children walking near the vehicle. Slowing down and leaving enough space gives drivers more time to react if a student suddenly enters the roadway.

What Should Drivers Do When Approaching a School Bus?

Drivers should start slowing down as soon as they see a school bus preparing to stop. Waiting until the red lights are already flashing can leave less time to react.

When approaching a school bus:

  • Slow down when its yellow or amber warning lights begin flashing.
  • Leave enough distance to stop safely.
  • Stop at the distance required by the state when the red lights activate.
  • Watch the front, rear, and sides of the bus for children.
  • Remain stopped until the law allows you to proceed.
  • Continue driving cautiously after the bus moves because children may still be nearby.

Drivers should also use caution around bus stops before and after a bus arrives. Children may be walking toward the stop, standing near the curb, or crossing between parked vehicles, making them more difficult to see.

What Happens If a Driver Causes a School Bus Accident?

A driver who fails to follow school bus laws may face traffic penalties. If that driver causes an accident or strikes a child, their actions may also be considered when determining responsibility for the resulting injuries.

However, another motorist is not always the only party involved in a school bus accident. Depending on what happened, responsibility could include:

  • The school bus driver
  • The school district
  • A private transportation company
  • A maintenance provider
  • Vehicle manufacturer

 More than one party may share responsibility for the same accident. Evidence such as bus camera footage, police reports, witness statements, driver records, and maintenance documents can help show how an accident happened and who may have contributed to it.

Know the School Bus Laws Where You Drive

School bus laws in New York, New Jersey, and Connecticut are all intended to make it safer for children to get on and off the bus, but the rules are not exactly the same across state lines.

Pay attention to flashing lights, leave enough room to stop, and know whether your state’s divided-highway rules require you to stop for a bus traveling in the opposite direction. A little extra patience and caution around school buses can help prevent serious accidents involving children.
